Registration

To become a Member ("Member") of the Services you need to complete the LongBeachFitness.com registration form. The Member then receives a username and a password. The use of the Services is at the Member or visitor's own risk. LongBeachFitness.com does not provide any warranties or guarantees. Neither do LongBeachFitness.com make any warranties as to the information included in the Services.

Storage of e-mail or other content

LongBeachFitness.com may provide Members or visitors with e-mail facilities, web-hosting or other services which mean that LongBeachFitness.com provides storage space on its own computer systems for these requirements. LongBeachFitness.com reserves the right to limit the storage space available to Members and visitors, by whatever means it so chooses, and to vary those limits whenever it so chooses. LongBeachFitness.com also reserves the right not to store certain material, or to delete certain material, if these limits are exceeded. The material which LongBeachFitness.com refuses to store, or that it deletes is done at its own discretion. LongBeachFitness.com accepts no liability for any loss, in any form, for any material that is lost by non-storage or deletion.

The current LongBeachFitness.com storage limit is 6 megabytes (6mb), at its discretion.

Your Obligation to LongBeachFitness.com

Members and visitors agree to abide by these Conditions and the Privacy Policy. Further, Members and visitors agree to abide by all applicable laws and regulations. There is an acceptance by Members and visitors that they will use the Services in a reasonable fashion. In particular Members and visitors will not use the Services in a way which will cause the transmission or posting of any material which is obscene, offensive, defamatory, libellous, menacing, annoying, inconvenient, threatening, illegal, immoral, not in the interests of the protection of children and which respects a person's privacy, to a reasonable person, or in the opinion of LongBeachFitness.com. Further the dispatching of e-mails en masse ("Spamming"), mail bombing, advertising and marketing are all forbidden using the Services. If a Member of visitor does such an act and loss is suffered then that Member or visitor is liable for the loss and is responsible for the damage caused.

If a Member or visitor, or any person for whom they are responsible, or is authorised by them causes loss or damage to anyone then the Member or visitor hereby agrees to indemnify LongBeachFitness.com, immediately on request, for the loss or damage, including any consequential loss and any legal, administrative, technical or other fees that may arise.

Members' user names and passwords are confidential. This confidentiality must be adhered to and Members are liable for all activities which occur under their username and password. LongBeachFitness.com accepts no liability for these activities, whatever they may be. If a Member believes that there is a misuse of their username and or password they should immediately inform LongBeachFitness.com of this by contacting info@LongBeachFitness.com

The Services and material provided by LongBeachFitness.com are all subject to intellectual property right protection and may not be used, distributed or displayed without the permission of LongBeachFitness.com. A Member or visitor's use of the Services gives them no rights in relation to intellectual property rights, for example copyright or trademark rights.

Members and visitors must provide their own computer equipment in order to use the Services and are responsible for all the telephone service charges associated with their use of these Services.

Limit of Liability

Members and visitors use the Services at their own risk.

Nothing in these Conditions exclude LongBeachFitness.com's liability for personal injury or death caused by negligence.

LongBeachFitness.com is not liable for any loss in contract or tort or otherwise, except as mentioned in the above paragraph, for any loss, whether it be indirect, consequential, loss of profits, loss of business, loss of data, loss of goodwill or any form of special damages.

LongBeachFitness.com's liability for any direct loss, subject to liability for personal injury or death, shall be limited to the amount actually paid by the Member or visitor to LongBeachFitness.com.

Each of the paragraphs relating to liability are separate and severable. If any of the said paragraphs prove, for any reason, to be ineffective then the other paragraphs shall remain in full force and effect.

Other Conditions

If any of the Conditions or paragraphs are considered to be ineffective or unenforceable, they shall not affect the validity and enforceability of the remaining provisions of these Conditions.
